ST. CLAIRSVILLE Judge Frank Fregiato heard several pleas and handed down sentences during Monday's session of Belmont County Common Pleas Court.
John David Henry, 55, St. Clairsville, was sentenced on one count of domestic violence, a felony of the third degree occurring Jan. 9, 2014. He was given a sentence of 36 months in the penitentiary with credit for time served. Fregiato noted Henry's numerous priors, included multiple charges of domestic violence, as well as the severity of his latest offense.
Donaven Jaquan White, 18, 651 South Zane Highway, Martins Ferry, was sentenced for aggravated burglary, a felony of the third degree occurring May 27, 2014. He was given 36 months in the penitentiary, with 18 months suspended. Defense asked Fregiato to consider this was White's first felony as an adult. Fregiato noted issues of attitude, pointing out disruptions in White jail stay and a failure to cooperate with the pre-sentence investigation.
Christopher Todd Carter, 26, 117 Walter St., Yorkville, was unable to reach plea agreement and will go to trial Sept. 4. He is charged with trafficking in drugs, a felony of the fifth degree occurring Dec. 2, 2013.
Chad Ernest Comas, 24, incarcerated, saw the revocation of his probation after admitting to a violation. He will serve the remaining 11 months of his sentence. This will include five months jail, six months EOCC. He was originally convicted of endangering children, a felony of the third degree occurring Sept. 1, 2011.
Nicole Marie Gust, 19, 3109 Washington St., Bellaire, was sentenced to 18 months in the penitentiary, suspended to three years off community controls. She was given a suspended sentence of six months jail, with 147 days of credit. She will serve six months EOCC. She was convicted of felonious assault, a felony of the fourth degree occurring May 9, 2013.
Lance Layton Lefler, 33, 810 Crestliner St., Conway, Arkansas, pleaded guilty to breaking and entering, a felony of the fifth degree occurring July 4, 2014. Sentence was set for Sept. 2. A pre-sentence investigation was ordered. His recognizance bond was continued.
Ricky Joe McGuire, 24, 65160 School St., Neffs, saw a new plea agreement date set for Sept. 15 and trial for Oct. 2. He is charged with illegal conveyance of drugs onto the grounds of a detention center, a felony of the third degree occurring Oct. 25, 2013.
William Russell Piper II, 24, 118 Third Avenue, Bellaire, pleaded guilty to one count trafficking in drugs, a felony of the fourth degree, and one count illegal manufacturing of drugs, a felony of the second degree occurring May 16, 2014. Sentence was set for Sept. 2. A pre-sentence investigation was ordered. He is currently under sentence in another case.
Joseph Edward Richards, 33 incarcerated, admitted to violating his probation and was sentenced to 10 months in the penitentiary. He was originally convicted of safecracking, a felony of the fourth degree occurring Sept. 12, 2011.
Franklin Dale Welch, 24, 46590 East Captina Highway Road, saw the termination of his treatment. A sentencing was set for Sept. 2. He was originally convicted of possession of drugs, a felony of the fifth degree occurring June 26, 2013. Another F-5 possession charge is pending. Defense asked Fregiato to consider Welch's military service and that his issues with addiction began when he was overseas. Fregiato pointed out the deliberate planning involved in his treatment violations.
In addition, this past Friday Barbara Tittle, 40, incarcerated, appeared before Common Pleas Court Judge John M. Solovan II and pleaded guilty to endangering children, a felony of the third degree occurring May 15, 2014. Sentencing was set for Oct. 24.
